The following terminology applies to these Terms and Conditions, Privacy Statement and any disclaimer notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Barking Hotel” “Ourselves”, “We” and “Us”, refers to our Company, HungerBurger Ltd. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. Website shall refer to Barkinghotel.com. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same. Some of the clauses might be applicable only in the event of online payment being acceptable. Currently all bookings are requests for booking and discretionary subject to availability.
Privacy Statement
We are committed to protecting your privacy. Authorised employees within the company, on a need to know basis only, use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible
Confidentiality
All the provisions of the Data Protection Act 1998 shall apply and as such, any information concerning the Client and their respective Client Records may be passed to third parties. However, Client records are regarded as confidential and therefore will not be divulged to any third party, other than our employees or if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.
We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.
Exclusions and Limitations
The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, this Company:
This Company does not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
Booking
You can only make a booking if you are 18 years old or over. If you arrive at the hotel and are under 18 years of age you will not be permitted to stay alone. We may require photo id as proof of age.
You are not allowed transfer or resell your booking, whether in whole or in part. If you transfer or resell (or attempt to transfer or resell), We will terminate your booking and retain any money paid to us for such booking. We may also refuse to take any further booking from you in the future.
You also agree not to use our facilities for any commercial activity without our prior written consent. We reserve the right to terminate your booking and retain any money paid to us for such booking if we believe that you are in full or part breach of this provision.
You may make a booking for any other person. You are responsible for ensuring that any Client in your booking complies with these terms as if that customer had made the booking.
The following applies only when online payments are accepted. All major Credit/Debit Cards and PayPal are acceptable online methods of payment. All payments are due in full at the time of booking unless otherwise advised by Barking Hotel. The rate for each room is as published on our website at the time of your Booking.
Identity Check
You must be able to show photo identification such as a passport or driver’s license or a valid credit or debit card if you are paying by cash for a walk-in booking at Barking Hotel. Online bookings are also subject to provision of identity documents and details of all guests. We reserve the right to cancel a booking in the event of discrepancy between the details submitted and actual identity of persons. We reserve the right to levy a £30 charge to cover any subsequent administrative expenses.
Cancellation and Refunds Policy
You may cancel a Booking and we will not charge you for the first night if you notify us before midday on your scheduled date of arrival. We will not pay a refund for any night for which notification is received after midday. All refunds shall be made to the initial payment source.
Right of Refusal
a. Guests with prior bookings: Except in circumstances beyond our control including but not limited to governmental or regulatory action imposed by local authorities, riots, failure of machinery or utilities, emergencies, natural disasters, etc we honour the booking. We may review or decline guest bookings if we believe there are legal grounds for not doing so. Such legal grounds may include discovery of false statements made by the guest. For example, if you guests arrive with pets or more persons that stated during booking. In these situations, we may decline the booking and in some cases claim damages from you if we are unable to re-let the room.
We reserve the right to refuse a guest entry and accommodation if, on arrival, management reasonably considers that the guest is under the influence of drink or drugs, is unsuitably dressed or is behaving in a threatening, abusive or otherwise unacceptable manner.
b. ‘Walk-in’ guests: Under the Hotel Proprietor’s Act 1956, we may refuse to let a room to a walk-in guest with no booking if that guest appears unable or unwilling to pay, or is not in a fit state to be received. This would be the case, for example, if the guest was drunk or if you had reasonable grounds for believing that the guest would be a nuisance to other guests.
Booking Changes
Subject to availability, you may change the length of stay, the room type and/or the scheduled date of arrival. You must notify us before midday on your scheduled date of arrival of any changes.
Discount Coupons, Vouchers and Special offers
We may give you Coupons and Vouchers in certain circumstances. Such Coupons and Vouchers are redeemable online or at the time of arrival. Vouchers have a client-specific code and can only be used by the person to whom it was issued and are not transferable. A Voucher is valid for a limited period of time. Specific conditions of use for voucher and other discount schemes will be specified when such offers are published online or sent to individual customers.
Vouchers remain the property of Barking Hotel at all times. We may cancel any Vouchers that are used in breach of these terms, for example we may cancel if you sell it to a third party, sell (or attempt to sell) it on an internet message board, bargains website or other internet exchange or auction site. We will not reimburse Vouchers for cash.
Parking facility
Parking facility is not provided onsite but Barking Hotel will offer help and advice to find the closest parking facility available.
Termination of Agreements
Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services shall be refunded.
Availability of Website
Unless otherwise stated, the services featured on this website are only available within the United Kingdom, or in relation to postings from the United Kingdom. All advertising is intended solely for the United Kingdom market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of the Company. The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.
